- положение федерального налогового кодекса, позволяющее лицу старше 55 лет исключать из налогооблагаемой базы до 125 000 долл. прироста капитала, полученного от продажи основного жилья один раз в жизни. Лицо должно прожить в доме как в основном жилище три из последних пяти лет, чтобы получить это право. Вычеты разрешаются (gance), если поступления от продажи дома не реинвестированы в другую собственность. Например, если 56-летний человек, купивший дом за 100 000 долл., продает его за 300 000 долл., то он имеет право исключить 125 000 долл. из 200 000 долл. дохода и заплатить налог на доход от прироста капитала с остающихся 75 000 долл. Конгресс установил это правило, чтобы пожилым людям не приходилось платить налог на доход от прироста капитала при повышении стоимости жилья, которое в основном вызвано инфляцией.
